Changing Your Status: From B2 Visitor to F1 Student in the US
Are you currently in the US on a B2 visitor visa but have decided to pursue an education here is the US? You might be eligible to change your status to F1 student without leaving the country. Here's a quick guide to get you started:
Eligibility & Requirements:
- Maintain a valid B2 visa throughout the application process. This means that you should NOT enroll in a program of study and basically, be a tourist!
- You must wait 90 days to start your application for this status. Our school recommends that you start the process 30 days before your tourist status expires.
- Gain acceptance to a Student and Exchange Visitor Program (SEVP)-approved school (like Tampa Language Center!) that offers I-20s.
Key Steps:
- Gather Supporting Documents: Proof of finances (Eligibility requires financial documentation from yourself or a sponsor showing that you have fiances to study and live in the US. It's best if you can show $10,000 USD, or the equivalent in your currency.), passport, current visa, and a copy of your I-94.
- Secure an I-20 Form: This document, issued by your chosen school, verifies your enrollment and eligibility for F1 status.
- Pay the SEVIS Fee: This mandatory fee helps fund student exchange programs. ($350)
- File Form I-539: This application with USCIS formally requests your change of status. If you are single, you will file online, and if you're married or have kids, you will send all of your documents to a USCIS service center. The form currently costs $370 to file plus $85 per EACH applicant.
- Get Your Fingerprints Done: 2-6 weeks after submitting your application, you will be requested to go to a local USCIS service center to do your fingerprints.
- Get Your Answer: Processing times can vary greatly. USCIS has an option to pay a premium processing fee for the I-539 ($1965), and you can get an answer in 4-8 weeks in some cases. Regular processing times can vary from 2-6 months. You can check current processing times here: https://egov.uscis.gov/processing-times/
Important Considerations:
- Timing is Crucial: Apply before your B2 visa expires. When you submit the documents for the change of status, you are automatically applying for an extension of your B2 status, so there is no need to worry about your status while you are waiting!
- Seek Guidance: Consult your school's Designated School Official (DSO) for advice and application support. Tampa Language Center is extremely experienced with this process and can help you do the process without the need for a lawyer! If you live near the Tampa/Sarasota area, contact us on WhatsApp: +1-813-988-7900
- Consider Legal Counsel: Immigration law can be complex. An immigration attorney can provide personalized guidance for your situation if it's more complex or you have another status that is not B2.
